AND DEFINITIONS

The terms used in the Regulations mean:

  1. Customer – a natural person, a legal person or an organizational unit that is not a legal person, which is granted legal capacity by special provisions, placing an order in the online store www.littlenomad.pl.
  2. Consumer – a natural person concluding a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
  3. Regulations - these regulations for the provision of electronic services within the online store www.littlenomad.com.pl
  4. Online store - online service available at www.littlenomad.pl , through which the Customer may, in particular, place orders.
  5. Goods – products presented in the online store.
  6. Sales contract - a contract for the sale of goods within the meaning of the Civil Code, concluded between the LittleNomad Iwo Iciachowski company running an online store, and the Customer, concluded using the store's website.
  7. Civil Code - Act of April 23, 1964, Civil Code (uniform text, Journal of Laws of 2014, item 121, as amended).
  8. Consumer Rights Act - Act of May 30, 2014 (Journal of Laws of 2014, item 827).
  9. Act on the provision of services by electronic means - Act of 18 July 2002 on the provision of services by electronic means (consolidated text, Journal of Laws of 2013, item 1422).
  10. Personal Data Protection Act - Act of August 29, 1997 on the protection of personal data (consolidated text, Journal of Laws of 2014, item 1182).
  11. Order - the Customer's declaration of will aimed directly at concluding a sales contract, specifying in particular the type and quantity of the goods.

II GENERAL PROVISIONS

  1. These regulations define the rules for using the online store available at www.littlenomad.com.pl

  3. The online store sells goods via the Internet, via the website www.littlenomad.com.pl
  4. In order to use the online store, the Customer should obtain access to a computer station or terminal device with Internet access on his own.
  5. The regulations are available on the website of the online store www.littlenomad.pl and are available to everyone at any time.
  6. The prices of goods available in the online store are given in Polish zlotys
  7. The offer for seasonal collections available on the online store's website is valid while stocks last.
  8. Littlenomad Iwo Iciachowski reserves the right to change the prices of goods in the online store's offer, withdraw goods from sale, introduce new goods to the online store's offer, conduct and cancel promotional campaigns on the store's websites or make changes to them.
  9. The online store makes every effort to ensure that the photos of the goods reflect their actual appearance as closely as possible. Due to the fact that the display settings as well as the parameters of individual monitors may differ from each other, the online store is not responsible for possible differences in the color range between the actual appearance of the product and the image displayed on the Customer's monitor.
  10. The online store reserves the right to change prices and delivery costs, in particular in the event of changes to the price lists of services provided by delivery entities. This change does not apply to orders in progress.
  11. The customer can pay for the ordered goods by bank transfer or PayPal.

III PLACING ORDERS

  1. Orders for goods in the online store www.littlenomad.com.pl can be placed via the order form, which is an integral part of the online store platform.
  2. An order may be placed by a Customer who provides the data required to complete the order or who has an account in the online store.
  3. A registered user (with an account) can make purchases multiple times - without the need to enter the data necessary to complete the order each time, track changes in the status of the placed order, view all orders placed, including archived (completed), make changes or cancel placed orders that have not been has been forwarded for processing, change of shipping address.
  4. You can place a one-time order without having to create an account in the online store.
  5. The Customer selects the goods ordered by adding them to the cart.
  6. The price given for each product is binding at the time the Customer places the order.
  7. When placing an order, the customer selects the shipping method, the costs of which are added to the order value. The cost of delivering the ordered goods, including shipping costs, is borne by the customer.
  8. In addition to shipping costs, a customer from outside the European Union also bears customs duties - these fees are added to the value of the order.
  9. After placing the order, the Customer receives e-mail information that it has been received by the online store (order confirmation).
  10. If it is necessary to cancel the order, the Customer should contact the online store by phone or e-mail as soon as possible.

IV ORDER PROCESSING – DELIVERY

  1. The basic condition for accepting an order for processing is to provide correct contact and shipping address details when placing the order.
  2. The online store reserves the right to verify the correctness and authenticity of each order by calling the Customer at the number provided by the Customer in the order form. Telephone contact will only take place on working days from 8:00 a.m. to 4:00 p.m.
  3. In the event of unavailability of the ordered goods, the Customer is immediately informed about this fact in order to decide how to complete the remaining part of the order (partial execution, extension of the waiting time for the missing goods, replacement of the missing goods with another one available in the store, cancellation of the entire order and refund of the money). for the ordered goods in the case of prepayment to the account).
  4. In the case of an order paid by transfer, the execution of the order begins after the payment made by the Customer is recorded.
  5. In the case of a cash on delivery order, the execution of the order begins immediately after the order is received in the online store (in the case of an order placed on a non-working day, the execution begins on the next business day).
  6. The online store processes orders within 1 to 10 business days.

  1. Goods ordered in the online store are sent only to the address provided by the Customer in the order form.
  1. Shipments are always well secured. Before signing for the shipment, please carefully inspect the packaging. In the event of visible significant damage, the Customer should not collect the parcel and a damage report should be prepared in the presence of the postman or courier.
  2. Proof of sale (receipt) is delivered electronically to the e-mail address provided in the order.

V COMPLAINT TERMS AND CONDITIONS

  1. The online store, as a seller, is liable to the Customer if the sold item has a physical or legal defect (warranty) pursuant to the provisions of the Civil Code.
  2. The online store is obliged to sell and deliver the goods to the Customer without any physical or legal defects.
  3. The customer has the right to file a complaint if the goods have a physical or legal defect (warranty).
  4. The sold goods have a legal defect if they are the property of a third party or are encumbered with the rights of a third party, and if the limitation in the use or disposal of the item results from a decision or ruling of a competent authority.
  5. A physical defect consists in the non-compliance of the goods with the sales contract. The goods are inconsistent with the sales contract, in particular if:
  6. The goods do not have properties that goods of this type should have due to the purpose indicated in the sales contract or resulting from the circumstances or purpose;
  7. The goods do not have the properties that the Online Store assured of their existence;
  8. The goods were delivered to the customer in an incomplete condition.
  9. The online store is liable under the warranty for physical defects that existed at the time the goods were delivered to the Customer or resulted from a reason inherent in the goods sold at the same time.
  10. The online store is exempt from liability under the warranty if the Customer was aware of the defect at the time of concluding the sales contract.

  12. If the sold goods have a defect, the Customer has the right:

– demand replacement of the defective goods with defect-free ones or demand removal of the defect or

– submit a declaration of proportional price reduction or withdrawal from the contract, in which case the address Iwo Iciachowski Milionowa 8/49 93-193 Łódź may immediately and without excessive inconvenience to the Customer replace the defective product with a defect-free one or remove the defect; however, if the goods have already been replaced or repaired by the Online Store or the obligation to replace the goods with defect-free ones or to remove the defect has not been met, the above limitation does not apply and the Customer may submit an appropriate declaration of a proportional price reduction or withdrawal from the contract.

– The customer cannot withdraw from the sales contract if the defect is insignificant.

– Instead of removing the defect proposed by the Seller, the Customer may request replacement of the goods with a defect-free one or instead of replacing the goods, demand removal of the defect, unless bringing the goods into compliance with the sales contract in the manner chosen by the Customer is impossible or would require excessive costs compared to the method proposed by the Seller. Complaints are considered no later than within 14 (fourteen) days from the date of receipt of the complaint by the Online Store, of which the Customer will be notified via e-mail to the e-mail address provided by the Customer or by SMS to the telephone number provided by the Customer or by post to the address indicated by the Customer.
  1. If the complaint is considered in favor of the Customer, the Online Store will immediately replace the defective product with a defect-free one or remove the defect or, if replacement is not possible, refund the amount due for the complained goods in accordance with Chapter VII.
  2. A claim for removal of a defect or replacement of a sold item with a defect-free one expires after one year from the date of detection of the defect. If the Customer is a consumer, the limitation period may not end before the expiry of 2 years.

VI RIGHT TO WITHDRAW FROM THE CONTRACT AND RETURN

  1. The customer - who is a consumer within the meaning of the provisions of the Civil Code, pursuant to the Consumer Rights Act - has the right to withdraw from a distance contract within 14 days without giving reasons and without incurring costs, with the exception of section 4. The period for withdrawal from the contract begins:

– from the date of receipt of the completed order (product release),

– from the date of receipt by the Consumer of the last part of the completed order, if the order is completed in parts.

To meet the deadline, it is enough to send the declaration before its expiry.

  1. Withdrawal from the contract in accordance with section 1 requires submitting a written declaration within the deadline specified in section 1
  1. In the event of withdrawal from a distance contract or an off-premises contract, the contract is deemed not to have been concluded.
  2. In the event of withdrawal from the contract (section 1), the Consumer is obliged to return the goods immediately, but no later than 14 days from the date on which he withdrew from the contract.
  3. The consumer is liable for any reduction in the value of the goods resulting from using them in a way that goes beyond what is necessary to establish their nature, characteristics and functioning.
  4. The direct cost of returning the product as a result of withdrawal from the contract is borne by the Consumer.
  5. The Consumer is not entitled to withdraw from the contract in relation to the contract (pursuant to Article 38 of the Consumer Rights Act), i.e., among others: for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the provision of services that after the entrepreneur has completed the service, he will lose the right to withdraw from the contract.
  6. In the case of the 2+1 promotion, we only accept returns of the entire order. Single products will not be accepted.

VII REFUND TO CUSTOMERS

  1. The online store does not accept cash on delivery shipments sent to it and is not responsible for the costs associated with such shipments.
  2. The online store will refund the amount due immediately, but no later than within 14 calendar days in the case of:

– cancellation of an order or part of an order (in which case the relevant part of the price will be refunded) paid in advance before its implementation;

– return of the goods by the Consumer (withdrawal from the contract), in this case the Online Store may withhold the refund of payments received from the Consumer until he receives the product back or the Consumer provides proof of sending it back, depending on which event occurs first;

– acceptance of the complaint or impossibility of replacing the product, removing the product defect or reducing the price.

  1. The online store will refund the payment using the same payment method used by the Consumer, i.e. the Consumer's bank account - if the order was paid in advance by transfer or upon delivery to the courier or post office, unless the Consumer expressly agreed to a different method of return. , which does not involve any costs for him.
  2. The online store is not responsible for non-refund of amounts paid or delay in refund if:

– despite sending a request to the Customer to send the Customer's bank account number to the e-mail address provided by him, the Customer will not send such a bank account number,

– if the response does not contain data enabling a return,

– if they are the result of the Customer providing incorrect address and name data or an incorrect bank account number.

VIII RULES FOR USING THE ONLINE STORE

  1. Littlenomad Iwo Iciachowski sells goods through the online store www.littlenomad.com.pl
  2. The online store takes steps to ensure the fully correct operation of the store to the extent that results from current technical knowledge.
  3. In order to ensure the security of the transmission of messages and data in connection with the services provided on the website, the online store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data.
  4. The customer is obliged in particular to:

– use all content posted on the online store's website only for your own personal use,

– use the online store in a manner consistent with the provisions of applicable law, the provisions of these regulations, as well as the general principles of using the Internet,

– not providing or transmitting content prohibited by law, e.g. promoting violence, defamatory or violating the personal rights of third parties,

– not to take actions such as sending or posting unsolicited commercial information (spam) in the online store.

  1. The customer is obliged to immediately notify the online store about any irregularities or interruptions in the functioning of the online store's website at the following address: www.littlenomad.pl . The notification should include your name and surname, correspondence address, type and date of occurrence of the irregularity related to the operation of the online store. The online store undertakes to consider each complaint within 14 days, and if it is impossible to inform the Customer within this period when the complaint will be considered.

IX PERSONAL DATA

PRIVACY POLICY

1. This Store's privacy policy is for information purposes only and does not constitute a source of obligations for the Store's Service Recipients and Customers.

2. The Service Provider is the administrator of personal data collected via the Store (Administrator). The Administrator will take special care to protect the interests of Service Recipients and Customers. The Administrator applies appropriate technical and organizational measures to ensure the protection of processed personal data, in particular it protects personal data against disclosure to unauthorized persons, loss and damage.

3. Data of Service Recipients and Customers are processed solely for the purpose of implementing and promoting the Store's services, in particular:

3.1. Conclusion and implementation of the Sales Agreement (placement and execution of Orders),

3.2. Agreement settlements,

3.3. Issuing invoices,

3.4. Setting up and maintaining an Account,

3.5. Considering reported complaints and handling returns,

3.6. Explanation of the circumstances of unauthorized use of services,

3.7. Performing obligations arising directly from applicable legal provisions,

3.8. For the purposes of direct marketing of the Administrator's Products and services, including, in particular, the provision of a voluntary free newsletter service containing commercial information within the meaning of the Act of July 18, 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2017, item 1219). ,

3.9. Conducting promotional campaigns, loyalty programs and competitions.

4. The above means that the Administrator transfers the data of Service Recipients and Customers to external entities supporting the process of concluding and implementing the Sales Agreement, in particular courier companies and IT companies supporting the above-mentioned. processes and entities intermediating in the settlement of payments.

5. The Administrator may process the data of Service Recipients and Customers in the following scope: name and surname, delivery address, e-mail address, contact telephone number, address of residence/business/registered office, bank account number. In the case of Entrepreneurs, the Administrator may additionally process the company name and tax identification number (NIP) of the Service Recipient or Customer.

6. The Administrator may also process operational data regarding the IP address of the Service Recipient's and Customer's devices for technical and statistical purposes and to improve the functionality of the Store.

7. The basis for processing personal data of the Service Recipient or Customer is their necessity to conclude and implement the Sales Agreement. The basis for processing the above data for direct marketing purposes is the prior consent of the Service Recipient or Customer or the fulfillment of legally justified purposes pursued by the Administrator.

8. Providing data by the Service Recipient and the Customer is voluntary, but at the same time it is necessary to provide services electronically.

9. The processing of the Service Recipient's or Customer's personal data for direct marketing purposes will be carried out only after obtaining his or her consent. The Service Recipient and the Customer have the right to cancel the above-mentioned. consent at any time and the right to object to the processing of his data for the above purpose.

10. The Service Recipient or Customer has the right to access personal data concerning him, rectify it, delete it or object to processing (unless it violates legal provisions), limit processing, as well as the right to transfer data.

11. The Service Recipient reserves the right to refuse to delete the User's data if their retention is required by applicable law or necessary to fulfill claims.

12. Personal data will be stored no longer than is necessary for the proper provision of services by the Administrator or compliance with applicable legal provisions, as well as for the period of limitation of civil law claims due to the Administrator against the Service Recipient or Customer.

13. The Administrator may process data contained in cookies regarding persons visiting the Store's websites for the following purposes:

13.1. Storing data related to the forms available in the Store, in particular the Registration Form and the Order Form, as well as the Basket data,

13.2. Adapting the functionality and appearance of the Store to the preferences of visitors,

13.3. Statistical analysis of the number of visitors and how they use the Store,

13.4. Remembering data necessary to log in and identify logged in Service Recipients and Customers,

13.5. Ensure transaction security.

14. Visitors to the Store's websites have the right not to accept the use of cookies. In such cases, some functionalities of the Store may have limited operation. The visitor has the option of expressing lack of such consent, for example by disabling the ability to save cookies in the web browser settings.

X NEWSLETTER

  1. The customer may consent to receiving commercial information, including commercial information electronically, by selecting the appropriate option in the registration form or later in the "Your account" tab ("Newsletter" link). If such consent is given, the Customer will receive an information bulletin (Newsletter) of the online store www.littlenomad.com.pl, as well as other commercial information sent by the online store on its own behalf and on behalf of third parties, to the e-mail address provided.
  2. The customer may unsubscribe from the Newsletter at any time by unchecking the appropriate box in the "Your account" tab (Newsletter link).

XI FINAL PROVISIONS

  1. These regulations come into force on the day of their publication on the online store's website, and the previous regulations cease to be in force.
  2. The current regulations are available in an archived version on the online store website.
  3. The local jurisdiction of the court resolving any disputes arising between Littlenomad Iwo Icichowski and the Customer is determined by the provisions of the Code of Civil Procedure.
  4. In matters not regulated in these regulations, the provisions of the following acts apply: Civil Code, on consumer rights, on the provision of electronic services and on the protection of personal data.
